Agreement to Terms

By accessing our website at www.activeandfunctional.com or engaging Active & Functional for personal training services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

Active & Functional is operated by Julio Riudavets, NASM-CPT, based in Westchester, NY.

Services Provided

Active & Functional offers personal training services including:

• In-person training sessions at the client's home in Westchester NY and Greenwich CT
• Online training sessions via video call
• 10-session training packages
• Initial assessment sessions
• Free educational resources including the Tendon-First Protocol

All services are provided by Julio Riudavets, a NASM-certified personal trainer. We do not provide medical advice, diagnosis, or treatment.

Health & Medical Disclaimer

By engaging our services, you confirm that you have either consulted with a medical professional regarding your fitness to exercise, or you accept full responsibility for your decision to train without doing so.

Active & Functional is not a medical provider. Nothing on this website or in our training programs constitutes medical advice. If you experience pain, dizziness, shortness of breath, or any unusual symptom during exercise, stop immediately and seek medical attention.

Assumption of Risk & Liability

You acknowledge that personal training and physical exercise carry inherent risks including, but not limited to, muscle soreness, injury, or other physical harm. By participating in training sessions with Active & Functional, you voluntarily assume these risks.

To the fullest extent permitted by law, Active & Functional and Julio Riudavets shall not be liable for any injury, loss, or damage arising from participation in training sessions or use of information provided on this website.

Booking & Cancellation Policy

The following policies apply to all training sessions:

• Cancellations must be made at least 24 hours in advance to avoid being charged for the session
• Late cancellations (less than 24 hours notice) or no-shows will be charged the full session fee
• Session packages are non-refundable once purchased, but sessions can be rescheduled with adequate notice
• Punctuality — sessions begin and end at the scheduled time regardless of late arrival

Exceptions may be made at Julio's discretion for genuine emergencies.

Payment

Payment terms are agreed upon at the start of the coaching relationship. Accepted payment methods will be communicated directly. Sessions are typically paid in advance or on the day of the session unless otherwise arranged.

Prices are subject to change. Any price changes will be communicated with reasonable notice to existing clients.

Free Resources & Email Communications

Free resources such as the Tendon-First Protocol are provided for educational purposes only and do not constitute a personal training program or medical advice. Results vary between individuals.

By providing your email address to access free resources, you may receive occasional emails from Active & Functional. You can opt out at any time by contacting us or replying "Unsubscribe" to any email.

Intellectual Property

All content on this website — including text, images, training materials, and the Tendon-First Protocol PDF — is the intellectual property of Active & Functional and Julio Riudavets. You may not reproduce, distribute, or use our content for commercial purposes without prior written permission.

Personal use of downloaded materials (such as the protocol PDF) for your own training is permitted.

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others. We reserve the right to restrict access to the website at any time without notice.
